In order to protect the integrity of the financial system, trust services in the Netherlands have been regulated by means of a licensing system and administrative and penal supervision. See the Act on the Supervision of Trust Offices 2018 that came into force on 1 January 2019, the Anti-Money Laundering and Anti-Terrorist Financing Act, the 1977 Sanctions Act and the Dutch Criminal Code. The trust services sector is also confronted with civil liability issues such as tort claims and directors’ and officers’ liability. What type of legal and regulatory framework governs the trust services sector? What are the effects of violation of this framework? What role do trust offices play in matters of corporate social responsibility (CSR)? In what ways does soft law regulate issues of corporate governance, human rights, labour rights and environmental issues? How do soft law sources and the current legal and regulatory framework interact? The trust services sector faces an overload of legal duties and responsibilities. What might or might not be expected of trust services providers in their role as gatekeepers in ensuring the integrity of the financial system?
Identification, understanding and management of risk factors that could have an impact on trust services as seen from an ethical perspective, the viewpoint of integrity and the Dutch legal and regulatory framework.
The topic will be dealt with from a practical point of view. Active participation during the course and input from all participants will be highly appreciated.
